Terms of Service

1. Agreement to Terms

By accessing or using Caption Cook ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Caption Cook is a recipe management application that allows you to:

• Parse and save recipes from URLs, text, or screenshots
• View nutritional information (macros) for recipes
• Organize and manage your recipe collection
• Convert measurements between unit systems

3. Account Registration

3.1 Account Creation

To use Caption Cook, you must create an account with a valid email address. You are responsible for providing accurate account information, maintaining the security of your password, and all activities that occur under your account.

3.2 Account Eligibility

You must be at least 13 years old to use Caption Cook. By using the Service, you represent that you meet this requirement.

4. Subscription Plans and Payment

4.1 Free Plan

The Free plan includes limited features as described on our pricing page. Free accounts may be subject to usage limits.

4.2 Paid Plans and Merchant of Record

Pro Monthly, Pro Yearly, and Lifetime plans are available. Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all purchases and handles payment processing, invoicing, sales tax, and refunds. By subscribing, you authorize Paddle to charge your payment method. Subscriptions auto-renew unless cancelled. You can cancel anytime through your account settings or by contacting Paddle at paddle.net.

4.3 Refunds

All refunds are handled by Paddle in accordance with Paddle's Buyer Terms. You have the right to cancel your purchase and request a refund within 14 days of the transaction date. To request a refund, contact Paddle's support team at paddle.net or email support@captioncook.app and we will assist you.

4.4 Price Changes

We may change subscription prices with 30 days notice. Price changes do not affect current billing periods.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Upload malicious content or code
• Use automated systems to access the Service excessively
• Resell or redistribute the Service
• Use the Service to infringe on intellectual property rights

6. User Content

6.1 Your Content

You retain ownership of recipes and content you create or save. By using the Service, you grant us a license to store, display, and process your content to provide the Service.

6.2 External Images

The Service allows you to paste images to associate with your saved recipes. When you paste an image, the Service detects and stores only the source URL. By providing an external image, you represent that you have the right to use and link to that image, and that it does not infringe on any third party's intellectual property rights. Caption Cook stores only the URL and does not host, copy, or redistribute external images.

6.3 Content Restrictions

You may not save or link to content that infringes on others' intellectual property, is illegal or harmful, or contains malware.

6.4 Content Removal

We reserve the right to remove content that violates these Terms.

7. Intellectual Property

7.1 Our Property

Caption Cook, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

7.2 Feedback

If you provide feedback or suggestions, we may use them without obligation to you.

8. Third-Party Services

Caption Cook integrates with third-party services (Paddle, Supabase, Anthropic, Unsplash, etc.). Your use of these services is subject to their respective terms and privacy policies. Paddle acts as the Merchant of Record for all transactions — see Paddle's Buyer Terms for details.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTION COOK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, DATA, OR GOODWILL, SERVICE INTERRUPTIONS, OR THIRD-PARTY CONDUCT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Caption Cook from claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

13.1 By You

You may terminate your account at any time through account settings.

13.2 By Us

We may suspend or terminate your account if you violate these Terms or for any reason with notice.

13.3 Effect of Termination

Upon termination your right to use the Service ceases, we may delete your account and data, and paid subscriptions are cancelled. Refund eligibility upon termination is subject to Paddle's Buyer Terms.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through the dispute resolution process below.

16. Dispute Resolution

16.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@captioncook.app to attempt informal resolution.

16.2 Arbitration

Any disputes not resolved informally may be subject to binding arbitration rather than court proceedings, except where prohibited by law.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Caption Cook
• Severability: If any provision is found unenforceable, other provisions remain in effect
• Waiver: Failure to enforce a right does not waive that right
• Assignment: You may not assign these Terms; we may assign them freely
